PROSECUTION CASES UNDER COMPANIES ACT
The Government in
the Department of Company Affairs (DCA) initiated 5836 prosecutions
during 2001-2002 against 1159 companies and their officers for
violation of various provisions of the Companies Act, 1956. A
total of 3847 cases were decided by the courts during this period
of which 1430 cases resulted in conviction and imposition of fine
of Rs.33,75,798/-. The number of cases pending with various courts
as on December 31, 2001 was 39,212 cases. A sum of Rs. 5,54,903
was awarded as cost to Registrars of Companies during the period.
The number of prosecution
cases pending in various courts in the country as on March 31,
2001 for violation of the provisions of the Companies Act by companies
was 37,223 cases.
